利用規約
本規約は、Wisteria Labが提供する本サービスの利用条件を定めるものです。 利用者は、本サービスを利用する前に本規約を確認し、同意のうえ利用するものとします。
Terms of Service
These Terms govern the use of all services provided by Wisteria Lab. By using the Services, you agree to be bound by these Terms.
第1条（適用範囲）
本規約は、Wisteria Lab（以下「当方」）が運営または提供するウェブサイト、アプリケーション、 ソフトウェア、コンテンツ、関連情報、サポートその他一切の提供物（有料・無料を問いません。以下あわせて「本サービス」） の利用条件を定めるものです。
利用者は、本サービスを閲覧、利用、購入、ダウンロード、インストール、またはこれらに類する方法で利用した時点で、 本規約に同意したものとみなされます。
Article 1 – Scope of Application
These Terms of Service ("Terms") govern the use of all websites, applications, software, content, information, support, and any other offerings (whether free or paid; collectively, "Services") operated or provided by Wisteria Lab ("we," "us," or "our").
By accessing, using, purchasing, downloading, installing, or otherwise using the Services, you agree to be bound by these Terms.
第2条（本サービスの提供および保証の否認）
当方は、本サービスを現状有姿で提供します。 当方は、本サービスについて継続的提供、完全性、正確性、有用性、特定目的適合性、動作保証、 無瑕疵、将来にわたる互換性等を、明示または黙示を問わず保証しません。
本サービスに有料機能または有料版が含まれる場合であっても、無料サービスと同様に、前項の保証は行わないものとします。
Article 2 – Service Provision and Disclaimer of Warranties
We provide the Services on an "as-is" basis. We make no warranties, express or implied, regarding the continuity, completeness, accuracy, usefulness, fitness for a particular purpose, proper functioning, freedom from defects, or future compatibility of the Services.
Even where the Services include paid features or a paid tier, the same disclaimers set out above apply equally.
第3条（禁止事項）
利用者は、本サービスの利用にあたり、以下の行為を行ってはなりません。
- 法令または公序良俗に違反する行為
- 当方または第三者の権利、利益、信用を侵害する行為
- 本サービスの運営を妨害する行為
- 不正アクセス、リバースエンジニアリング、解析、改変等の不適切な行為
- 本サービスを不正または不適切な目的で利用する行為
- その他、当方が不適切と判断する行為
Article 3 – Prohibited Acts
In using the Services, you must not:
- Violate any applicable law or regulation, or act contrary to public order and morality;
- Infringe the rights, interests, or reputation of us or any third party;
- Interfere with the operation of the Services;
- Engage in unauthorized access, reverse engineering, disassembly, analysis, or modification of the Services;
- Use the Services for any unauthorized or improper purpose; or
- Engage in any other conduct that we determine to be inappropriate.
第4条（知的財産権）
本サービスに関する文章、画像、UI、プログラム、商標、ロゴ、デザインその他一切の知的財産権は、 当方または正当な権利を有する第三者に帰属します。法令上認められる場合を除き、 当方の事前承諾なく複製、転載、改変、再配布その他の利用をすることはできません。
Article 4 – Intellectual Property Rights
All intellectual property rights in the Services — including but not limited to text, images, UI elements, software, trademarks, logos, and design — belong to us or to third parties who hold the applicable rights. Except as expressly permitted by applicable law, you may not reproduce, republish, modify, redistribute, or otherwise use such materials without our prior written consent.
第5条（免責および責任の制限）
当方は、本サービス（有料・無料を問いません。）について、その正確性、完全性、有用性、安全性、継続性、 特定目的適合性、第三者権利の非侵害等に関し、明示または黙示を問わず、いかなる保証も行いません。
利用者は、自らの責任と判断において本サービスを利用するものとし、当方が作成または提供するアプリ、 ソフトウェア、コンテンツ、表示内容、説明、情報その他一切の内容の利用結果について、当方は責任を負いません。
当方は、本サービスの利用または利用不能、データ消失、端末不具合、表示不良、誤作動、 外部サービス連携の不具合、第三者との紛争、逸失利益、間接損害、特別損害その他一切の損害について、 当方に故意または重過失がある場合を除き、責任を負わないものとします。
法令上認められる範囲で当方が責任を負う場合であっても、当方の責任は、 利用者が当該損害の直接の原因となった本サービスに関して現実に支払った対価の総額を上限とします。
Article 5 – Disclaimer and Limitation of Liability
We make no warranties, express or implied, regarding the accuracy, completeness, usefulness, safety, continuity, fitness for a particular purpose, or non-infringement of third-party rights with respect to the Services (whether free or paid).
You use the Services at your own risk and judgment. We assume no responsibility for the results of your use of any apps, software, content, displayed information, descriptions, or other materials we create or provide.
We shall not be liable for any damages arising from use of or inability to use the Services, data loss, device malfunction, display errors, malfunctions, failures in integration with third-party services, disputes with third parties, lost profits, indirect damages, special damages, or any other damages, except where such damages are attributable to our willful misconduct or gross negligence.
To the extent we are liable under applicable law, our total liability shall not exceed the amount actually paid by you for the specific aspect of the Services that directly caused the damage.
第6条（医療情報・研究用途に関する注意）
本サービスに医療画像、DICOM関連機能、画像表示機能、解析補助機能またはこれに類する機能が含まれる場合であっても、 別途明示しない限り、本サービスは診断、治療、医療判断その他医療行為を目的とするものではありません。
研究用途、検証用途、教育用途または業務補助用途として提供される機能については、 医療機器としての承認・認証・届出を前提としない場合があります。利用者は、自らの責任において 用途適合性を確認のうえ利用するものとします。
Article 6 – Notice Regarding Medical Information and Research Use
Even where the Services include medical imaging, DICOM-related features, image display functionality, analysis assistance features, or similar capabilities, the Services are not intended for diagnostic, therapeutic, medical-decision-making, or other clinical purposes, unless otherwise expressly stated.
Features provided for research, verification, educational, or workflow-assistance purposes may not be based on regulatory approval, certification, or notification as a medical device. You are responsible for verifying that the Services are appropriate for your intended use before using them.
第7条（サービス内容の変更・停止）
当方は、利用者への事前通知なく、本サービスの全部または一部の内容変更、追加、停止または終了を行うことがあります。 当方は、これによって生じた損害について責任を負いません。
Article 7 – Changes and Suspension of Service
We may, without prior notice to you, modify, add to, suspend, or terminate all or part of the Services. We shall not be liable for any damages arising from such changes.
第8条（サポートおよびアップデート）
当方は、本サービスに関するサポート、バグ修正、機能改善、OS更新対応、将来のアップデート提供義務を負うものではありません。 ただし、当方の判断により、任意にこれらを実施することがあります。
Article 8 – Support and Updates
We are under no obligation to provide support, bug fixes, feature improvements, OS compatibility updates, or future updates for the Services. However, we may, at our discretion, provide any of the foregoing.
第9条（本規約の変更）
当方は、必要と判断した場合、本規約を変更することがあります。変更後の本規約は、 本ウェブサイトまたは本サービス上に掲載した時点で効力を生じるものとします。
Article 9 – Changes to These Terms
We may revise these Terms when we deem it necessary. Any revised Terms shall take effect from the time they are posted on our website or within the Services.
第10条（準拠法・管轄）
本規約は日本法に準拠し、本サービスに関して紛争が生じた場合には、 当方の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。
Article 10 – Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Any disputes arising in connection with the Services shall be subject to the exclusive jurisdiction of the court with jurisdiction over our principal place of business as the court of first instance.
